2016: HOMEOWNERS ASSOCIATION OFFICIALS STILL LACKING LEGAL MANDATE FROM MEMBERS

Whaaat, up to now Pacita Square Homeowners Assn officials are still wandering whether the were elected by the members or just on holdover positions since last scheduled election. Maybe a new strategy will help solve this problem of mandate from the members. A new law was passed last 2010 regarding Magna Carta of Homeowners. From what I understand, the law now specifically defined what are mandatory memberships for homeowners to join a Homeowners Association. Pacita Square Homeowners are now explicitly excluded from those required mandatory membership to an Association. Nowhere in the deed of absolute sale nor in the Transfer Certificate of Title can be found an annotation that owners of house and lot at Pacita Square or Pacita 2, must join a homeowners association. Homeowners, give some effort to check your documents. Thus, its very clear only those interested to join Pacita Square Homeowners Association are the homeowners to be called members. Non-members though shall not be denied basic social services that a member of Homeowners Assn enjoy, except non members must pay for the corresponding services. Therefore, if only the present leadership or group of interested homeowners will conduct a house to house survey to come up with homeowners willing to become members (respecting all rules and regulations, paying dues and fees as required), a new lists of active members can be determined. These new lists of members shall form part of the incoming election, and the question of quorum pestering each election period will be resolved. If there are only 20 interested homeowners to become active, then they are the only group entitled to elect new officers among themselves. Non members, or those who opted not to become members meantime, cannot have a voice in these elections and any active member can now claim legal mandate from the members. In the absence of legal impediments, these new officers can now plan, implement their programs for the welfare of their members, which may results to the betterment and improvement of our subdivision. Maybe if their programs are good and beneficial, others may finally join and become active members again.

About Mang Kanor......

The community was shocked when they learned about the accident which resulted to instant death of Mang Kanor. From the statements of the Barangay officers manning the patrol vehicle present in the area of accident, a speeding motorcycle overtook them and at the intersection, collided with the bicycle ridden by Mang Kanor. Both were thrown meters away due to the strong impact and unfortunately resulted to sudden demised of Mang Kanor. About five or more years ago, we started riding our bicycle going around the perimeter of both Phase 1 and Phase 2 of Pacita 2. Our routes usually took us from Rainbow Ave. up to the end of Main Ave towards the Viva Factory area near the creek. It was a wide road and not very crowded one. During school days, the traffic usually are the tricycles and some school vans. These routes has been the routine for all those years, and if we were still have the will and strength, we sometimes proceed to Pacita 1 or the Southwood area. Another route from Southwood area towards Sugar Road in Carmona usually end up in Carmona market, for a refreshing buko juice drink, and ride back home to end our biking day. A quiet simple person and in good health for that matter Mang Kanor takes pride in his ability to tackle those routine without much difficulty. Frankly, sometimes he beats me on uphill climb especially when I lacked sleep night before our trip. With his passing away, i loss a friend and cycling mate. Farewell my friend and may you find eternal peace in God's hands.

New Monthly Dues and 2 years terms for elected Directors

In a General Assembly meeting called last 22 October 2011, it was announced that amendment to the Association's By Laws was done regarding: 1. Monthly Dues and 2. Terms of office of elected Directors/Officers.

As announced the new monthly dues for the members of the Association will be Pesos 50.00 per month, and the Term of office of Directors/Officers shall be for two (2) years, effective this coming election year 2011 to be held on 5 November 2011.

Members questioning the validity of these amendments need not engaged in a word war!

All they have to do is to check whether the rules as stated in the By Laws was properly observed or followed. Thus, a correct assessment of the actions taken by the present Board of Directors can be properly appreciated.

One Year na pala ...2010 na!

mabilis ang panahon, isang taon na pala ang nakalipas at wala pa rin bago pangyayari sa pacita square homeowner's association. wala man lamang mga social gatherings para sa mga homeowner's, at ang huling mga balita ay wala pa rin nagaganap na eleksyon para sa mga officers.

sana ngayon 2010, magka ayos na ang lahat ng mga members, lalo na yun mga talagang hagad ay makapaglingkod sa pamayanan at hindi pangsariling kapakanan lang ang dahilan ng kagustuhan maging pinuno ng association.
